General Terms and Conditions of Sale

The present conditions of sale are concluded on the one hand by the company Comme un diadème, S.A.S. whose registered office is located at 288A Montée Rouge, 30310 Vergèze, registered in the Nîmes Trade and Companies Register under number 888 366 747 hereinafter referred to as "Comme un diadème" and managing the website www.commeundiademe.com and, on the other hand, by any individual or legal entity wishing to make a purchase via the website www.commeundiademe.com hereinafter referred to as "the buyer".

Article 1. Purpose 

The present conditions of sale aim to define the contractual relationship between Comme un diadème and the buyer and the conditions applicable to any purchase made through the website www.commeundiademe.com. The acquisition of a product through this website implies unreserved acceptance by the buyer of these conditions of sale which the buyer acknowledges having read prior to ordering. Before any transaction, the buyer declares on the one hand that the purchase of products on the website www.commeundiademe.com is not directly related to his professional activity and is limited to a strictly personal use and on the other hand to have the full legal capacity, allowing him to commit himself under the present general conditions of sale.

Article 2. Products 

The products offered are those listed on the website www.commeundiademe.com of the company Comme un diadème, within the limits of available stocks. The company Comme un diadème reserves the right to modify at any time the range of products. Each product is presented on the website in the form of a description of its main technical characteristics (hair type, length, size and type of base, density). The photographs are as faithful as possible to the models but do not commit the seller. A slight variation may exist between models of the same reference over the months or years. In this case, the photos are taken for the new model of this same reference. The sale of the products presented on the site www.commeundiademe.com is intended for all the purchasers residing in the countries which fully authorize the entry on their territory of these products. 

Article 3. Tariffs 

The prices shown on the product sheets in the internet catalog are in Euros (€). Comme un diadème reserves the right to modify its prices at any time, it being understood however that the price appearing in the catalog on the day of the order will be the only one applicable to the buyer. The prices indicated include delivery charges. Outside the European Union and French overseas departments and territories, prices are invoiced exclusive of VAT. It is the customer's responsibility to find out about and pay any other taxes applicable in the destination country (customs duties, sea taxes, etc.) in accordance with Incoterm DAP (Delivered at place). Shipping for toppers and wigs is free worldwide. Other products (Hairbun and Sensitive grip) are sent (free shipping) only to Metropolitan France and the European Union.

Article 4. Order and payment terms 

Before placing an order, the buyer must create an account on the website www.commeundiademe.com. The account creation section is accessible directly from the side menu bar. At each visit, the buyer, if he wishes to order or consult his account (status of orders, profile, etc.), will have to identify himself using his personal information and identifiers. Comme un diadème assumes no responsibility for the use of personal identifiers by a third party. 

 Comme un diadème offers the buyer the possibility of ordering and paying for its products in several stages, with 3 payment options to choose from:

Secure payment by credit card: the buyer selects the products he wishes to order in the "Cart", modifies it if necessary (quantities, references...), checks the delivery address or enters a new one. Then, the shipping costs are calculated and submitted to the buyer, as well as the name of the carrier (DHL). Then, the buyer chooses the credit card payment method. The next step is to check all the information, read and accept the present general terms and conditions of sale by ticking the corresponding box, and then confirm the order by clicking on the "Confirm my order" button. Finally, the buyer is redirected to the secure interface in order to enter his personal credit card details in complete security. If the payment is accepted, the order is recorded and the contract is definitively formed. Payment by credit card is irrevocable. In the event of fraudulent use of the card, the buyer may demand the cancellation of the payment by card, and the sums paid will then be credited back or refunded. The responsibility of the bank card holder is not engaged if the disputed payment has been proven to have been made fraudulently, at a distance, without physical use of the card. To obtain reimbursement of the fraudulent debit and any bank charges that the transaction may have generated, the cardholder must dispute the debit in writing with his or her bank within 70 days of the transaction, or even 120 days if the contract linking him or her to the bank so provides. The amounts debited will be reimbursed by the bank within a maximum of one month after receipt of the cardholder's written objection. The holder shall not be charged any costs for the return of the sums.

Confirmation of an order implies acceptance of these terms and conditions of sale, acknowledgement of having full knowledge of them and waiver of the right to invoke its own terms and conditions of purchase. All the data provided and the recorded confirmation will be considered as proof of the transaction. If the buyer has an e-mail address and if he or she has provided it on the order form, Comme un diadème will send him or her an e-mail confirming that the order has been registered.

Article 5. Reservation of ownership 

The company Comme un diadème retains full ownership of the products sold until full payment of the price, in principal, costs and taxes included.

Article 6. Withdrawal 

Under Article L121-20 of the Consumer Code, in the European Union, the buyer has a period of fourteen working days from the delivery of his order to exercise his right of withdrawal and thus return the product to the seller for reimbursement without penalty, except for the cost of return by Colissimo with delivery against signature or any other delivery system. The delivery with delivery against signature is strongly recommended in order to avoid a possible loss of the parcel. In case of withdrawal, the customer must be able to transmit the proof of return of the package if necessary.

The withdrawal request should be sent only to contact@commeundiademe.com or via the site's return form. Requests for withdrawal should not be sent via private messages on social networks (Facebook or Instagram). The return form is available in the contact section of the site, after logging into the customer account.

The product must then be returned in the same condition in which it was sent, in its original intact packaging. Refunds will only be issued if the product has not been washed, curled, cut, disheveled or damaged. The parting of the product must be positioned in the center. The product will be carefully inspected before refund. The lace part of the wigs must not have been cut. In case the product requires a new shampoo (application of serum or other on the hair), a penalty of 30 euros will be applied to the refund. If the product is returned with a clip cut or torn off, a penalty of 30 euros per clip will be applied. The external packaging must not be damaged either, under penalty of a 10 euros penalty.

In case of an order for a product outside the European Union, the buyer will also be fully refunded if the product is returned. The buyer has 5 working days to notify the company of his withdrawal. He must also return the product via the carrier of his choice within 5 working days. The customer must be able to transmit the proof of return of the parcel if necessary.

Credit card fees and other additional costs (e.g. customs fees) are not refundable either. In case of return of a product sent outside the EU, the customer must make sure that the return formalities do not involve customs clearance fees for the seller because it is not an import but a product return. You must declare "Return of the product to the retailer". In case of error of the customer, the expenses of customs clearance will be deduced at the time of the refunding.

Custom orders are payable in advance and are non-refundable. Production times can be long (about 3 months, sometimes a little longer). Exceeding the deadline for the receipt of the product will not be a reason for refund.

Products cut or modified specifically at the request of the customer at the time of ordering (fringe, curtain bangs, Diadem cut, addition of adhesive tape) via the form "available options", are not eligible for the return policy.

Products ordered following a face-to-face meeting (e.g. with a MEETING code) are not eligible for return.

The return of a product that is not eligible for the return policy (custom order, product cut on demand) will be reshipped at the customer's expense.

In some cases and on specific request of the customer, a root effect can be done on a new product or on a product previously purchased at Comme un diadème against payment of the service. Since the service is performed remotely, the color will be as close as possible to what is requested and cannot be refunded in case of dissatisfaction.

Tickets for Comme un diadème events are neither exchangeable nor refundable. The price of the ticket is deductible from the purchase of a hair topper or wig on the day of the event.

Article 7. Delivery 

Deliveries are made to the address indicated on the order form, which can only be in the agreed geographical area. The orders of toppers capillaries and wigs are made by DHL. Hairbuns orders are sent by Colissimo and sensitive grips by simple letter. Delivery times are given as an indication only; if they exceed thirty days from the order, the sales contract may be terminated and the buyer reimbursed. The company Comme un diadème can provide by e-mail to the buyer the tracking number of his package. The buyer is delivered to his home by the DHL deliveryman, or in a DHL relay point. The risks associated with transport are the responsibility of the buyer from the time the items leave the premises of the company Comme un diadème. The buyer is required to verify in the presence of the deliveryman, the condition of the packaging of the goods and its contents upon delivery. In case of damage during transport, any protest must be made to the carrier within three days of delivery. For deliveries outside metropolitan France, the buyer agrees to pay all taxes (customs duties, VAT etc.) due under the laws of the country where the order is received.

Article 8. Guarantee 

All products supplied by the company Comme un diadème benefit from the legal guarantee provided by articles 1641 and following of the Civil Code. In case of non-conformity of a product sold, it can be returned to the company Comme un diadème which will take it back, exchange it or refund it. All claims, requests for exchange or refund must be made by post to the following address Comme un diadème S.A.S., 49 avenue Charles de Gaulle, 30470 Aimargues, within fourteen days of delivery.

Article 9. Liability 

The company Comme un diadème, in the process of distance selling, is only bound by an obligation of means. It cannot be held responsible for any damage resulting from the use of the Internet network such as loss of data, intrusion, virus, break in service, or other involuntary problems.

Comme un diadème does not have a shop or business premises, it is only an e-commerce website. However, you are not alone in your purchase and you can be advised on colour, base size and length based on your photos by sending them via the support form. After ordering the topper, you can then try it on at home and send it back if it doesn't suit you, respecting the 14-day withdrawal period.

We use natural Brazilian "Remy" hair. The term "Remy" means that the hair and the cuticles of the strand are oriented in the same direction on the hair topper. This is in contrast to non-Rémy hair, which is assembled loosely. They are therefore more prone to tangling and damage.

You should choose the Cap size of the topper according to the extent of your alopecia and the density of hair you wish to acquire. It is preferable that the clips are not attached in the area of alopecia where the scalp can be quite sensitive. In addition, extensive alopecia will require the addition of a high density of hair to compensate for the initial low density.

For extensive alopecia, we recommend 18 × 18 cm or 20×20 cm bases. These bases will provide real coverage, density and comfort of use. Larger base sizes are available for very large alopecia.

The smaller bases (15×15 cm) will give a little less density to the hair. But they will allow you to tie your hair in a high ponytail more easily.

The life span of a topper will partly depend on how well it is cared for. The typical life span is between one and two years. To increase the life of your topper, you should not wash it too frequently.

Hair should not be washed too frequently. Every 4 weeks or more is a good rhythm. Clips should be closed before washing the hair and the hair should be detangled before and after washing. In case of dry hair ends, we recommend adding a little argan oil to moisturize the fiber hair.

Natural hair can be heated, straightened and curled without any problem. However, as with your own hair, you should not overdo it to avoid damaging the fiber hair.
